Residential Property damage from a Windstorm $185,000

We represented a Broward County homeowner for Hurricane Irma-related damages. The Insured reported the loss to their insurance company almost on the last day their Hurricane Irma claim could be submitted.  

The insurance company, one of the largest in the region, refused to make any payment alleging the late claim submission resulted in prejudice by precluding timely investigation and allowing avoidable damage to the interior of the home.     Once the insurance company inspected the property it also denied the claim based on its finding that there were no wind damages that allowed water to enter the home.  

After the claim was denied, we filed a Civil Remedy Notice of insurer violation and requested mediation through the Department of Financial Services.   The carrier was presented with objective evidence from our roofing expert that multiple openings to the roof were the result of the windstorm.  Upon review of the reports, the case settled prior to mediation to the satisfaction of the client.
